This document sets out the general conditions governing the vehicle rental contract between the lessor (THERA RESORT S.L.) and the lessee (client), hereinafter “the lessee”, who declares to have read, understood, and fully accepted these conditions upon signing the corresponding rental contract.


1. Condition of the vehicle

  • The vehicle will be delivered to the lessee in optimal general condition, clean, and without visible defects or damage.
  • Any visible damage at the time of delivery will be duly noted and documented through a delivery report signed by both parties.
  • The vehicle must be returned in the same condition in which it was delivered, at the agreed location, date, and time.
  • The lessor reserves the right to recover the vehicle, without prior notice and at the lessee’s expense, if improper use or breach of these conditions is detected.

2. Obligations of the lessee

The lessee agrees to:

  • Perform basic periodic checks on the condition of the vehicle during the rental period: tire pressure, oil levels, coolant, battery, and any maintenance warnings on the instrument panel.
  • Immediately inform the lessor of any mechanical, electrical issue or warning light that may appear.
  • Bear the costs resulting from negligent or improper use, including damages and administrative fees for failing to report incidents on time.

3. License and minimum age

  • The driver must be at least 21 years old and hold a valid driving license for more than one year.
  • Only persons authorized in the rental contract may drive the vehicle, provided they hold valid permits in accordance with Spanish and European legislation.

4. Prohibited uses

The lessee may not use the vehicle for:

  • Off-road driving, sports activities, rallies, towing, or other extreme uses.
  • Transporting illegal substances (alcohol, drugs, etc.).
  • Transporting goods or passengers for commercial or paid purposes.
  • Carrying out illegal acts or acts contrary to applicable legislation.

In the event of infringement, the lessee shall assume:

  • The full cost of the vehicle (in case of confiscation or total loss).
  • Fines, compensations to third parties or passengers.
  • Financial losses due to the lessor’s loss of income.

5. Insurance coverage and invalidation thereof

Insurance coverage will not apply if:

  • The vehicle is subleased without the lessor’s written authorization.
  • The driver is under the influence of alcohol or drugs at the time of the incident.
  • The vehicle is driven by an unauthorized person.

In such cases, the lessee shall be liable for:

  • All material damage to the vehicle.
  • Damage to third parties.
  • Medical expenses or passenger claims.
  • Days of immobilization of the vehicle during repair.
  • All penalties and resulting legal costs.

The lessor may apply an administrative fee for each of the above incidents.


6. Fines and traffic regulations

  • The lessee agrees to comply with the current Highway Code.
  • Any infringement during the rental period shall be the responsibility of the lessee, including the fine amount and an additional administrative fee.

7. Geographical use of the vehicle

  • The vehicle may not leave Spanish national territory without the express and written authorization of the lessor.
  • If the lessee wishes to transport the vehicle by sea (e.g., to islands), they must request this in writing at least 7 days in advance.
  • In case of authorization, the lessor may apply an additional fee or require special insurance coverage.

8. Allowed mileage

  • Each contract will include a specific daily or total mileage limit, indicated according to the rented vehicle model.
  • If exceeded, an additional charge per extra kilometer will be invoiced as stipulated in the individual rental contract.

9. Fuel policy

  • The vehicle is delivered with a specified fuel level, usually a full tank, and must be returned in the same condition.
  • Otherwise, a refueling charge and the cost of the missing fuel will be applied.

10. Security deposit and method of payment

  • The lessee must pay a security deposit, the amount of which will depend on the rented vehicle model and will be detailed in the contract.
  • The deposit will be refunded once the good condition of the vehicle is verified, within a maximum of 7 business days, deducting any damage, fine, or pending charge.

11. Vehicle inspection

  • A joint visual inspection will be carried out at the time of delivery and return of the vehicle.
  • Both parties will sign a delivery and return report, which will serve as proof of the vehicle’s condition.

12. Cancellation and no-show

  • Cancellations made less than 24 hours in advance may incur a charge of XX% of the first rental day.
  • In the event of a no-show without prior notice, the full amount of the first day will be charged.

13. Exclusive use

  • The vehicle will be used exclusively by the drivers designated in the contract.
  • Any breach of this clause will invalidate the insurance and transfer all liability to the lessee.

14. Modifications to the contract

  • Any modification, extension, or cancellation of this agreement must be made in writing and approved by both parties.

15. Jurisdiction and applicable law

  • This contract shall be governed by the laws of the Kingdom of Spain.
  • In the event of a dispute, both parties submit to the courts of Málaga (Spain), expressly waiving any other jurisdiction.
